Terms and Conditions

These terms cover your use of shop.airmaxsystems.ca (the "site") and any order you place with us. By using the site or placing an order, you agree to these terms. If you don't agree, please don't use the site.

1. Who we are

This site is operated by Airmax Systems ("Airmax", "we", "us", "our"). In these terms, "you" means the person using the site or placing an order.

2. Who can buy from us

You must be at least 18 years old and able to enter into a contract under Canadian law. If you're ordering on behalf of a business, you confirm you have the authority to do so and that the business will be bound by these terms.

3. Your account

You can check out as a guest or create an account. If you create an account, keep your login details private. You're responsible for activity on your account. Let us know right away if you think someone else has used it.

4. Prices, currency, and taxes

Prices on the site are in Canadian dollars (CAD) unless we say otherwise. Applicable Canadian sales taxes (GST, HST, PST, or QST, depending on your province) are added at checkout. Shipping is calculated at checkout based on the destination and the items in your cart.

We try to keep prices accurate, but errors happen. If a product is listed at the wrong price, we may cancel your order and refund what you paid. We'll let you know if this happens.

5. Placing an order

When you submit an order, you're offering to buy. We can accept or refuse it. The contract between us is formed only when we send a confirmation that your order has shipped.

We may refuse or cancel an order for any reasonable reason — for example, stock issues, pricing errors, suspected fraud, or a shipping address we can't service. If we cancel, we'll refund any payment you've made for that order.

6. Payment

We accept the payment methods shown at checkout. Payments are processed by Stripe. We don't store full card details on our servers.

7. Shipping

We ship using the carriers shown at checkout. Estimated delivery times are estimates, not guarantees. Once a carrier has your order, delays caused by the carrier, customs, or weather are out of our hands.

Risk of loss passes to you when the carrier picks up your order. Title to the goods passes to you when we've received payment in full.

8. Returns and refunds

Our return process is set out in our Returns & Refunds policy. You'll need a return authorization (RMA) from us before sending anything back. The Returns & Refunds policy is part of these terms.

9. Product information and availability

We do our best to describe products accurately, but specifications, photos, and weights are approximate. Manufacturers sometimes update parts without notice. If a small variation matters to you, contact us before ordering.

Stock levels change quickly. Adding an item to your cart doesn't reserve it. We may sell out between the time you order and the time we ship.

10. Using this website

You agree not to:

  • Use the site for anything illegal or to harm others.
  • Interfere with how the site works (for example, by scraping, hacking, or sending malware).
  • Copy or republish our content without our permission.
  • Pretend to be someone you're not.

We can suspend or block access to the site if you break these rules.

11. Our content

The content on this site — including text, layout, photos, and product descriptions we've written — belongs to us or our suppliers. You can use it for your own personal, non-commercial purposes. You can't reuse it commercially without our written permission. Brand names and product names belong to their owners.

12. Warranties

Most products we sell are made by other manufacturers and come with the manufacturer's warranty. Warranty terms vary by product and brand — check the documentation that comes with your order, or ask us before you buy.

Beyond any manufacturer's warranty, and except for legal protections that can't be waived under applicable consumer protection law (including the British Columbia Sale of Goods Act and Business Practices and Consumer Protection Act), the site and the products are provided "as is". We don't promise the site will be uninterrupted or error-free.

13. Our liability

Where the law allows us to limit our liability, our total liability to you for any claim related to a product or your use of the site is limited to the amount you paid for the product the claim relates to.

We're not liable for indirect or consequential losses — for example, lost profits, lost data, lost production time, or damage caused by delays — even if we knew those losses were possible.

Nothing in these terms limits any rights you have under Canadian consumer protection laws that can't legally be waived.

14. Privacy

How we handle your personal information is set out in our Privacy Policy.

15. Changes to these terms

We may update these terms from time to time. The current version always lives on this page with the "last updated" date at the top. If you place an order after we've updated the terms, the version in effect at that time applies to your order.

16. Governing law and disputes

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. Any dispute about these terms or your order will be handled by the courts of British Columbia, and you and we agree to those courts having jurisdiction.

If you live in another Canadian province, this doesn't take away any rights you have under your province's consumer protection laws.

17. Other things to know

If a court decides that part of these terms can't be enforced, the rest still apply. If we don't enforce part of these terms right away, we haven't given up the right to enforce it later. These terms, together with our Privacy Policy and Returns & Refunds policy, are the whole agreement between you and us about the site and any order you place.
